[Giveaway name]: Official Rules

  1. Sponsor. The "[Giveaway name]" giveaway (the "Giveaway") is organised by [Sponsor name] (the "Sponsor"). Contact: [how to contact the Sponsor].
  2. Who can enter. Open to people who live in [country or region] and are at least 18 years old on the day they enter. Employees of the Sponsor and members of their households cannot enter. The Giveaway is void where prohibited or restricted by law.
  3. Giveaway period. Entries are accepted from [date] to [date], [time zone]. Entries received outside this period do not take part.
  4. How to enter. Follow the sponsor’s Instagram account and comment on the giveaway post. Entering is free. No purchase or payment of any kind is necessary to enter or win, and a purchase does not improve the chance of winning. Limit: one entry per person. Entries made with multiple or fake accounts, or by automated means, will be disqualified.
  5. Prize. One winner receives: [prize description]. Approximate total retail value: [value]. The prize cannot be exchanged for cash or transferred. Any taxes on the prize are the responsibility of the winner.
  6. How the winner is chosen. After the Giveaway period ends, the Sponsor will pick the winner in a random draw among all eligible entries. The chance of winning depends on the number of eligible entries received. The draw is made with the giveaway.tools winner picker. The Sponsor will publish the verification code and the link of the result, so the draw can be repeated and checked by anyone who has the list of entries.
  7. Winner announcement. The Sponsor will contact each winner through Instagram from its official account and may announce the winner’s public user name. A winner who does not answer within 48 hours loses the prize, and the next backup drawn takes the place. The Sponsor will never ask a winner for a payment, a password or card details to hand over the prize.
  8. Release of Instagram. This Giveaway is in no way sponsored, endorsed or administered by, or associated with, Instagram. By entering, each entrant fully releases Instagram from any liability related to the Giveaway.
  9. Privacy. The Sponsor uses the information entrants provide (public user name, comment and, for winners, the delivery details they send) only to run the Giveaway, contact the winners and deliver the prizes. It is not sold or used for another purpose, and it is deleted when it is no longer needed for the Giveaway.
  10. General conditions. By entering, entrants agree to these Official Rules and to the decisions of the Sponsor, which are final. The Sponsor may disqualify anyone who tampers with the entry process or breaks these rules, and may cancel or change the Giveaway if it cannot run as planned for reasons beyond its control.

What must giveaway rules include?

Official rules say who organises the giveaway, who can enter, when it starts and ends, how to enter for free, what the prize is, how the winner is chosen and contacted, and that the platform is not involved. Instagram, Facebook and YouTube require that last sentence in their published policies.

The generator above writes ten short clauses from your answers and adds what the chosen platform asks for. It also warns you when the way to enter conflicts with a platform rule, for example asking people to share a post on Facebook.

Instagram (Meta)

  • You are responsible for the lawful operation of the giveaway: official rules, offer terms, eligibility (age, residency) and any registration or approval the law asks for.
  • The giveaway must include a complete release of Instagram by each entrant.
  • It must state that the promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram.
  • Do not tag content inaccurately or encourage people to do so (for example, tagging themselves in a photo they are not in).
  • Instagram does not help run the promotion; you use the service at your own risk.
“Promotions on Instagram must include the following: A complete release of Instagram by each entrant or participant. Acknowledgement that the promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram.”

Facebook (Meta)

  • The promotion must comply with the law: give entrants the official rules, disclose offer terms and eligibility, and register it with the authorities where required.
  • Participants must fully release Meta from liability.
  • Participants must acknowledge that the promotion is in no way sponsored, endorsed, administered by, or associated with Meta.
  • The promotion must not require or incentivize people to share, repost, tag others or publicize it in any other way.
  • Meta does not help administer the promotion; you do it at your own risk.
“You must also require participants to (a) fully release and hold Meta harmless from liability, and (b) acknowledge that the promotion is in no way sponsored, endorsed, administered by, or associated with Meta.”

X (formerly Twitter)

  • Include a rule saying that anyone found using multiple accounts to enter will be ineligible.
  • Do not encourage posting the same update over and over ("whoever reposts this the most wins"). X recommends a rule that multiple entries in a single day will not be accepted.

  • Hashtags must be relevant to the post they are added to.
  • Follow the X Rules and all applicable laws; compliance is your responsibility.
“Please be sure to include a rule stating that anyone found to use multiple accounts to enter will be ineligible.”

Not confirmed.TikTok: we did not find one official TikTok page with promotion rules for ordinary creator giveaways (outside TikTok Shop), like the ones Instagram, Facebook, YouTube and X publish. The release and "not sponsored by TikTok" sentence in our template follows the other platforms and is a precaution, not a quoted TikTok requirement.

Not confirmed.TikTok Shop: the policy page failed to load in our browser on the day of the check; the text and its 09/28/2026 date were read through an automated fetch.

Example: a Facebook giveaway that asks people to tag friends

What the generator does with a common mistake.

Northwind Tea, one gift box worth $60

Platform: Facebook. Way to enter typed in the form: “Comment on the giveaway post and tag two friends.”

The generator shows 1 warning: Meta’s policy says a promotion on Facebook must not require or incentivize people to share, repost or tag others. Change the way to enter.

The release clause it writes for Facebook:

Release of Facebook. This Giveaway is in no way sponsored, endorsed or administered by, or associated with, Meta. By entering, each entrant fully releases Meta from any liability related to the Giveaway.

Fix: “Comment on the giveaway post.” The warning disappears and the rules are ready.

The same way to enter is accepted for Instagram, where tagging friends in a comment is common and the guidelines forbid only inaccurate tagging of content. Each platform has its own text, which is why the generator asks first where the giveaway runs.

With the rules published, run the draw with the giveaway winner picker and announce the winner with the verification code. The template already says that the code and the link of the result will be published.

How to run a fair giveaway

When the law asks for more than rules

Two United States laws we read in full, and what we did not check.

New York: prizes over $5,000

  • Covers games of chance run to promote, advertise or sell consumer products or services, with no payment required to enter.
  • When the total announced value of the prizes is over $5,000, a statement must be filed with the New York Secretary of State at least 30 days before the promotion starts, with a $100 non-refundable fee.
  • The rules and the minimum number and value of prizes must be published in all advertising copy.
“where the total announced value of the prizes offered is in excess of five thousand dollars shall file with the secretary of state, at least thirty days prior to the commencement of such game, contest or promotion”

New York General Business Law § 369-e, "Use of games of chance in selling commodities" (most recent revision: 2014-09-22). Open the official page (opens in a new tab) · read on

Florida: prizes over $5,000

  • Covers contests, games of chance and sweepstakes run in connection with the sale of consumer products or services.
  • It is unlawful to require an entry fee, a payment or proof of purchase to enter, to reject entries arbitrarily, to rig the result or to fail to award the prizes offered.
  • When the total announced value of the prizes is greater than $5,000, the rules and the list of prizes must be filed with the Department of Agriculture and Consumer Services at least 7 days before the start ($100 fee), and a trust account or surety bond for the prize value is required.
“To require an entry fee, payment, or proof of purchase as a condition of entering a game promotion.”

The 2026 Florida Statutes, § 849.094, "Game promotion in connection with sale of consumer products or services". Open the official page (opens in a new tab) · read on

Both laws deal with games of chance used to promote products or services. Below $5,000 in total prizes, neither asks for a filing. The generator shows a warning as soon as the prize value you type goes above that amount.

Entries that are also advertising. When people must post about your brand to enter, the United States Federal Trade Commission treats the post as an incentivized endorsement. Its guidance says that making the word “contest” or “sweepstakes” part of the hashtag should be enough to tell readers. FTC, Endorsement Guides: What People Are Asking (opens in a new tab).

  • Keep entry free. YouTube, TikTok Shop and the Florida law above say so in their own words, and Meta treats games where people pay to play for a prize as gambling.
  • Say where the giveaway is open. A rule such as “open to residents of one country, void where prohibited” keeps you out of places whose rules you have not read.
  • Keep a record: the rules as published, the list of entries, the verification code and the proof link.

Not confirmed.Other places: registration, bonding or licensing rules of other U.S. states and of other countries (for example Canada, the United Kingdom, the European Union, Australia or Brazil) were not checked. Instagram’s own page warns that promotions in Brazil must follow the rules of the Secretariat of Prizes and Bets of the Ministry of Finance.

Not confirmed.FTC: the page was read through an automated fetch (the site refused our browser) and shows no "last updated" date; the 2023 date is the revision of the Guides mentioned in the text.

Frequently asked questions

Do I need official rules for a social media giveaway?

The platforms say so. Instagram and Facebook hold you responsible for official rules, offer terms and eligibility; YouTube requires a set of Official Rules with specific contents; X asks for rules about multiple accounts and repeated entries.

What must giveaway rules include?

Who organises it, who can enter, the start and end dates, how to enter for free, the prize and its value, how and when the winner is chosen and contacted, and the release and “not sponsored by” sentence the platform asks for.

What is the Instagram giveaway disclaimer?

Instagram’s Promotion Guidelines ask for a complete release of Instagram by each entrant and an acknowledgement that the promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram. The generator writes both sentences.

Can I require people to share the post or tag friends?

Not on Facebook: Meta’s policy says a promotion must not require or incentivize sharing, reposting or tagging others. On X, do not reward posting the same update repeatedly. The generator warns you when the way to enter conflicts with one of these rules.

Do I have to register a giveaway?

It depends on the place and the prize. In the United States, New York and Florida ask for a filing before the start when the total prize value is over $5,000 and the giveaway promotes products or services. Other states and countries were not checked on this site.

Is “no purchase necessary” required?

The template says entry is free. YouTube’s policy requires the contest to be free to enter, Florida law forbids requiring a payment or proof of purchase in a game promotion, and TikTok Shop requires giveaways to be entirely free.

Is this template legal advice?

No. It is a starting text built from the platforms’ published policies. For large prizes, several countries or regulated products, have a lawyer review it.

Where do I publish the rules?

Somewhere every entrant can open before entering: in the caption or description when they are short, or on a page or document linked from the post and from your profile.
